Billing, renewals and cancellation
This page is a plain-language summary for customers and does not replace our Terms of Service. Where this summary and the Terms differ, the Terms govern — see Section 11 (Fees, Billing and Taxes) and Section 15 (Term, Suspension and Termination).
What you are charged
Subscriptions are billed in advance on a recurring basis through our payment processor. By subscribing you authorize us and our payment processor to charge the payment method on file for all fees when due, on each renewal, and for any rooftops, seats or modules you add. Fees are quoted in U.S. dollars and may include per-store, per-seat, module, overage, implementation and professional-services components, as set out in your Order Form. Fees are exclusive of tax.
Where we have agreed to invoice you instead, invoices are due net 30 days from the invoice date.
Renewal
Unless your Order Form says otherwise, each subscription term renews automatically for a further period equal to your then-current term. Either party can stop that by giving written notice of non-renewal at least 30 days before the end of the current term. Monthly subscriptions renew monthly and may be canceled effective at the end of the then-current monthly period.
Changing your subscription
Adding rooftops, seats or modules mid-term is charged at our then-current rates, prorated for the rest of the billing period, and carried into later renewals. Reductions take effect at your next renewal and do not produce a refund or credit for the current period.
Price changes
We may change fees with effect from a renewal, on at least 30 days' notice before that renewal date. If you do not agree to a change, you may terminate effective at the end of your current term.
Refunds
Unless your Order Form says otherwise, fees are based on the subscription you purchased rather than on how much you use it, payment obligations are non-cancelable, and fees already paid are non-refundable, except where our Terms expressly say otherwise.
The main express exception: if we terminate for convenience, we give 60 days' written notice and refund any prepaid, unused fees for the terminated part of your current term.
Billing questions and disputes
If you think a charge is wrong, tell us in writing within 30 days of the invoice or charge date with enough detail for us to look into it, and we will work it through with you. Undisputed amounts stay payable when due. Please raise a dispute with us before initiating a chargeback.
Late payment
Past-due amounts accrue interest at 1.5% per month, or the maximum the law allows if that is lower. If an amount is more than 10 days past due we may suspend access until it is paid.
How to cancel
Email adam@dmsfocus.com from the account or billing contact on file, at least 30 days before your renewal date. We will confirm in writing and tell you the effective date. You can request an export of your data on or after termination.
How the service is delivered
DMSFocus and Focus Connect are online software. Nothing is shipped. After your order form is signed we set up your account, connect your DMS report schedule and load your history, and your order form states the expected go-live date. Your users then sign in at the web address we provide, from any modern browser.
Payments and security
Card and bank payments are processed by Stripe, a PCI DSS Level 1 certified payment processor. We never see or store your full card number. All prices and invoices are in U.S. dollars (USD).
Charges appear on your card or bank statement as DMS FOCUS.
